| By purchasing, using or accepting delivery of this equipment, the client accepts, without limitation or qualification, the following terms and conditions: |
| Berien (Pty) Ltd (hereinafter “Berien”) does not warrant in any way that the equipment is suitable for the purpose for which it was purchased. No information given by Berien or any of its Directors or representatives, or anyone who purports to act on behalf of Berien, may be construed to be medical advice. The client notes and agrees that each individual is different and that effectiveness of the use of the equipment cannot be guaranteed or predicted for the purpose the equipment was purchased. |
| The client / person using the equipment hereby undertakes to obtain suitable clinical medical advice from a registered practitioner at own cost to ensure that the use of this equipment is suitable for the patient’s unique needs. Any such advice must be followed strictly. Berien cannot exercise any control over the use of this equipment and can accordingly not be held liable for any consequence of use or misuse thereof whether direct or consequential. |
| The client purchases the equipment to use on a “self-test / self-help” principle. The client undertakes to follow the instructions as contained in the User Manual at all times and to take all reasonable precautions against damage of all possible kinds. By accepting or using the equipment, the client confirms receipt of the User Manual. |
| Berien’s liability with regard to malfunctioning of the equipment is expressly limited to the amount the client paid for the equipment. Berien has no liability for any damage caused by physical, electrical or other causes beyond the manufacturer’s control apart from damage to the equipment due to inherent or factory defects. Berien nor any of its suppliers shall be liable to any user or to any other person in respect of any loss or damage of whatsoever nature caused by using the equipment apart from what is covered by manufacturer; |
| Berien shall not be liable and the client hereby indemnifies Berien, its Directors and its suppliers from and against, any and all losses, liability, costs or damage suffered or incurred by a user or any other person arising out of or in connection with the use, provision or distribution of any feature or service which may be promoted, displayed on, or associated with the equipment under all circumstances; |
| Accountability for payment of the full amount is accepted by the client until the date of full receipt by Berien of the amount invoiced by payment, whether by self-payment, reimbursement by medical aid and /or co-payment by member of medical aid. Berien will deliver after receipt of full payment. The equipment remains the property of Berien until full payment has been received in Berien’s bank account. |
| Berien does not warrant that medical aid claims will be successful. Berien does not have control over medical aid decisions and can only submit claims. You authorize that this invoice may be claimed on your behalf directly from your medical aid, unless it was paid in full before delivery or shipment. Berien will in case a total amount more than the Berien invoice is received in Berien’s bank account, repay the amount received above the VAT invoice amount upon receipt of bank info for EFT payment. Unless the client takes all actions required by medical aid to claim after the client received copy of VAT invoice from Berien, an additional claim contractor’s fee of 10% may be applicable to be paid before delivery / shipment. It is the member’s responsibility to ensure that details on the invoice corresponds 100% with membership info at medical aid; |
| The client authorises Berien to store and use personal information as required by Berien for normal business purposes. Berien will safeguard information and not share it with any party unless essentially required for business like financial auditing and legal records, medical aid claims etc. The client hereby indemnifies Berien, its Directors and its suppliers from any liability when information is provided for essential purposes like for example to medical aid and to fulfill SAHPRA licencing requirements; |
| Berien administers the manufacturer’s warranty of 3 year from its registered address. Berien will at no point apply or intend to apply a wider warranty than the manufacturer’s provided warranty. Return of product for inspection or repair will be paid for by buyer. In case of “no fault found” an inspection fee equal to Berien’s standard quote fee will be payable. If this amount is not paid within 3 months, Berien may destroy our sell the equipment to cover costs. |
